    What if I already have a will?

    Does having a will mean my family will avoid court?

    No. A will actually goes through probate, which is a court process. It helps guide decisions, but it does not avoid court delays or fees.

    Can someone challenge my will after I pass?

    Yes. Wills can be contested especially if...
    • Someone feels left out unfairly
    • there are questions about your mental capacity
    • there's suspected influence

    Does my will control everything I own?

    

    No. Many people don't realize this. A will does NOT control:
    Jointly owned assetsLife insurance (with named beneficiaries)Pensions or RRSPs with beneficiaries

    Is my will Private?

    No. Once probated, a will becomes a public document. Anyone can access it.

    If I have a will, is my family fully protected?

    Not necessarily. A will handles legal distribution, but it does NOT:

    • Guide your family step-by-step

    No. Most people still need a will + trust together. A will often acts as a backup. ("pour-over")
